2. The Purpose of a Court Ordered DUI
Evaluation?
Illinois Law requires every individual arrested for driving under the influence to undergo a DUI
Evaluation prior to his or her sentencing for a DUI offense. The purpose of a DUI Evaluation is to
determine the extent of an individuals alcohol/drug use, including the risk that the individual poses
to public safety. Such determination is made by a DUI Evaluator assessing the offender's past and
present use of substances, including reviewing the offender's entire driving history for substance
related driving offenses. A DUI offender is assigned a Risk Classification after completing his/her DUI
Evaluation.
The State of Illinois has reserved Risk Classifications for DUI Offenders based on their past/present
use of substances (symptoms of substance use disorder), results or refusal of chemical testing
during arrest, and prior history of DUI arrests. An offender's assigned Risk Classification is provided
to the adjudicating court through the offender's completed DUI Evaluation. The adjudicating court
will require the DUI offender to complete the services and/or treatment that is recommended from
the assigned Risk Classification. Each Risk Classification and the bare minimal services/treatment
recommendations are as follows:
3. Minimal Risk Classification
First time DUI Offender (no prior statutory summary
suspension), BAC between .08-.14, and displayed no
symptoms of a substance use disorder. A DUI Offender
that receives this Risk Classification is required to
complete 10-hours of DUI Risk Education.

DUI, or one prior statutory summary suspension, or

DUI; And/or a BAC of .20 or higher as a result of the
most current DUI arrest; And/or two or three
symptoms of a substance use disorder. A DUI offender
that receives this Risk Classification is required to

treatment, and engage in continuing care/aftercare.
6. High Risk Classification
Four or more symptoms of a Substance Use Disorder (regardless
of driving record); And/or within the ten year period prior to the
date of the most current (third or subsequent) arrest, any
combination of two prior convictions or court ordered
supervisions for DUI, or prior statutory summary suspensions, or
prior reckless driving convictions reduced from DUI, resulting

Classification is required to complete a minimum of 75 hours of
