There was pieces in there speaking of classified and explosive materials
that from my background and understanding of these areas, it would have
leapt out at me. As a matter of fact, my heart leapt when I read that version
of it, when I saw that part about explosive.
Q: Back in January of 2000, how did you receive Exhibit 38?
A: I dont remember.
Q: Was there a previous revision - - or an original that you received?
A: I dont know. What I remember is really a short document with a Phase 1
price and a Phase 2 price, which I submitted to my plant manager. He said,
Proceed with Phase 1.
Q: And you do recall receiving a dust collection system study by
sometime in January of 2000, or in that time frame?
A: Yes.
Q: Did you fully read the dust collection system study from when you
received it?
A: I would - - I would say yes.
Q: Did you read it?
A: I read - - I generally read everything that I get in front of me on proposals,
because I - - my life deals with what-ifs.
Q: Youre basing your answer on your general procedure?
A: My answer would be yes.
A: Since we ended with Perigon, let me ask you about that. Did you bring
your children to your plant?
A: Yes.
Q: would you have brought your children to your plant if you believed you were
taking them to a place where they could be killed by a dust cloud explosion?
A: Not no, but hell, no.
Q: If you knew that there was a dust cloud explosion potential there that could
have threatened you, your family and your friends, would you have sat on your hands,
or would you have done something about it?
A: I would have done something about it.
Q: Are you 100-percent positive that never sent you these e-mails that we now - -
these dust collection studies that say, Watch out. You ve got a dust
potential explosion?
A: I never had anything - -
Q: If they had sent you the very documents that ** showed you, could you
have prevented this whole tragedy from occurring?
A: Yes.
Q: All you needed was somebody like to have the human decency to tell you
there was a problem, and you could have fixed it very quickly, true?
A: We could have looked into it and come to a - - some sort of engineering solution.
Q: Have you ever received from any dust collection program - - or document
that even claimed to be a final report rather than one that had editorial notes on it?
A: No.
Q: And *** has not yet shown you anything that purports to be a final version
that has no editorial comments on it, has he?
