Subpart 201.1 - PURPOSE, AUTHORITY, ISSUANCE
This section introduces the Defense Federal Regulatory Supplement (also knows as
DFARS) and speaks to its scope and purpose.
DFARS 201.101 (Purpose): “The primary objective of DoD acquisition is to acquire
quality supplies and services that satisfy user needs with measurable
improvements to mission capability and operational support at a fair and
reasonable price.”
DFARS 201.104 (Applicability): Makes clear that the FAR and DFARS also apply to
foreign military sales and NATO cooperative treaty projects.

Subpart 201.1 - PURPOSE, AUTHORITY, ISSUANCE
DFARS 201.107 (Certifications): prohibit new requirements for certifications by a
contractor unless it is specifically imposed by statute or there is a written
justification approved by the Secretary of Defense upon a request by the
Undersecretary for Acquisition and Sustainment.
DFARS 201.109 (Dollar Threshold Adjustments): dollar threshold adjustments occur
without regard to contract award date (as required by statute). Also, a matrix of
these potential adjustments is available at PGI 201.109.

Subpart 201.1 - PURPOSE, AUTHORITY, ISSUANCE
DFARS 201.170 (Peer Reviews): The Office of the Principal Director, Defense Pricing,
Contracting, and Acquisition Policy (DPCAP) will conduct peer reviews of competitive
and noncompetitive procurements valued over $1 billion. DPCAP may be involved
in peer reviews for procurements below $1 billion upon request.
What is the $1 billion criteria?
? If the NTE exceeds $1 billion.
? IDIQ contracts where the maximum amount is above $1 billion.
? For non-competitive procurements, the greater of the government objective
amount and contractor proposed amount.

Subpart 201.2 - ADMINISTRATION
DFARS 201.201(Maintenance of the FAR; 201-1 The Two Councils): Specifies that the
DAR Council operation is pursuant to DOD Instruction. The Instruction sets out the
members of the DAR Council, its policy, and responsibilities.
This regulations also discusses how new FAR and DFARS regulations are proposed
(through the Director of the DAR Council). The public has the option of also
submitting a memo:
? Succinctly state the problem created by the regulation or legal reason
requiring the change.
? Attached the proposed changes and a conformed copy of the new/updated
regulation.
? Discussion/explanation of why a change is necessary.

Subpart 201.3 – AGENCY ACQUISITION REGULATIONS
DFARS 201.301 (Policy): The DFARS supplements the FAR and contains:
? Requirements of law
? DOD-wide Policy
? Delegations of FAR authority
? Deviations from the FAR
? Policies that go beyond internal DOD procedures or a significant cost
to contractors
When publication in the Federal Register is required, an analysis of public
comments must be included in the internal request for approval.

Subpart 201.3 – AGENCY ACQUISITION REGULATIONS
DFARS 201.304 (Agency Control and Compliance Procedures): The Undersecretary
for Acquisition and Sustainment must approve any clause or policy that go beyond
internal DOD procedures or a significant cost to contractors/offerors.
When publication in the Federal Register is required, an analysis of public
comments must be included in the internal request for approval.
New certification requirements are not permitted unless authorized by statute or
written justification is provided to the Undersecretary and the Secretary of Defense
approves in writing.

Subpart 201.4 – DEVIATIONS FROM THE FAR
DFARS 201.402 (Policy): The Principal Director, Defense Pricing, Contracting, and
Acquisition Policy, is the approval authority for class deviations involving
procurement integrity (FAR 3.104 or DFARS 203.104), Rights in Data and Copyrights,
Cost Accounting Standards Administration, FAR 31.1/DFARS 231.1 (cost principles),
Contracts with Commercial Organizations (FAR 31.2/DFARS 231.2), FAR Part 32 and
DFARS Part 232 (except FAR 32.7/8 and DFARS 232.7/8).
DFARS 201.403 (Individual Deviations): contracting officers outside the United
States may deviate when contracting with NATO countries or NATO or UN
organizations and the governments or organizations will not agree to the standard
clauses.

Subpart 201.4 – DEVIATIONS FROM THE FAR
DFARS 201.404 (Class Deviations): The senior procurement officials from the DoD
agencies may approve any class deviation not noted in 201.402 if it does not:
? Have a significant impact beyond the internal operating
procedures of the agency
? Does not have a significant cost or administrative impact on
contractors/offerors
? Diminish a preference given to small businesses
? Extend to requirements of other agencies like the SBA or DOL
