Human
A person, living, breathing entities capable
of feeling and showing emotions, such as
love, hate, compassion, and indifference.
Rights
A moral or legal entitlement to have or
obtain something or to act in a certain way

legitimate claims.
Human Rights Violation
It can be committed by people who work for the
State and their behavior is then considered to be
the behavior of the State.

Basic Principles
of Human Rights
First : “None of us asked to be born. And regardless of who
our parents are and what they own, all of us are born equally
naked and helpless, yet with his own hand, his own will and
talents”.
? All of us have equal rights to life, and share the same
inherent human dignity. Thus we all have the right to life, to
dignity and develop ourselves.
- These are traditionally known as the rights of men.
Second: “Even if we
may not know who
our parents are, we
are never born
without parents, and
never outside
society, a society
with its own peculiar
culture, history and
resources”.
Third : “Once a society reaches a
certain degree of complexity, as
almost all societies have, society can
act only through government. But a
government always acts as agent

society it self; it never becomes the
people themselves.

WHAT IS HUMAN RIGHTS-BASED
POLICING?
RIGHTS-BASED POLICING
? Compliance with Local and International human rights
standards in policing.
? Police Officers are DUTY-BEARERS with obligations to
respect, protect and fulfill human rights. Strengthening
their capacities is also a must in order for us to empower
the claim-holders.
? Citizens are CLAIM-HOLDERS whose rights must be
respected and protected by the police. There is also a
need for them to be empowered so that they will
learn on how to claim their rights
Characteristics of
Human Rights-Based Policing
1. Strict observance to Police Policies and Operational
Procedures
When police officers follow and apply proper
procedures, they uphold human rights while doing all that is
possible to ensure that the subsequent case to be filed in
court against a suspect would prosper, in the higher interest
of justice.
2. Adherence to National, Domestic and International Laws,
Treaties, Standards, and Protocols on Human Rights
? PNP personnel must know, understand and adhere to
local laws related to human rights, like, but not limited to
RA7438, RA9745, RA9851
? international human rights standard.
3. Professional Competence and Courteous Service
A Police or Law Enforcement Professional must:
? have a high degree of practical knowledge about
laws and ordinances, police policies and
regulations, and police operational procedures;
? and must be courteous and considerate.
4. Respect for Rule of Law and Civilian Supremacy
All police officers must always remember that “…
sovereignty resides in the people and all government
authority emanates from them.”
5. Pro-Democracy and Pro-Citizen
The PNP must always remain responsive and relevant
to the needs of the community.

Rights Institution (NHRI) created under
the 1987 Philippine Constitution,
established on 05 May 1987 by virtue of
Executive Order No. 163.

violations involving civil and political

protection of human rights of all persons
within the Philippines, as well as Filipinos
residing abroad, and provide for preventive
measures and legal aid services to the

story…
A group of scientists placed 5 monkeys in
a cage and in the middle, a ladder with
bananas on the top.
Every time a monkey went up the
ladder, the scientists soaked the rest
of the monkeys with cold water.
After a while, every time a monkey
went up the ladder, the others beat
up the one on the ladder.
After some time, no monkey dare to
go up the ladder regardless of the
temptation.
Scientists then decided to substitute one of
the monkeys. The 1st
thing this monkey did
was to go up the ladder. Immediately the other
monkeys beat him up.
After several beatings, the new
member learned not to climb the
ladder even though never knew
why.
A 2nd
monkey was substituted and the same occurred. The 1st
monkey participated on the beating for the 2nd
monkey. A 3rd
monkey was changed and the same was repeated (beaten).
The 4th
was substituted and the beating was repeated and
finally the 5th
monkey was replaced.
What was left was a group of 5 monkeys
that even though never received a cold
shower, continued to beat up any monkey
who attempted to climb the ladder.
If it was possible to ask the monkeys why they would
beat up all those who attempted to go up the ladder,
I bet the answer would be…
“I DON’T KNOW --- THAT’S HOW THINGS ARE DONE
AROUND HERE.”

  • 4. DEFINITION OF TERMS Human A person, living, breathing entities capable of feeling and showing emotions, such as love, hate, compassion, and indifference. Rights A moral or legal entitlement to have or obtain something or to act in a certain way
  • 5. DEFINITION OF TERMS Human Rights ? A right that is believed to belong justifiably to every person ? Supreme, Inherent and Inalienable rights to life, to dignity & self-development. State Actors Anyone who acts on behalf of the government.
  • 6. DEFINITION OF TERMS Non-State Actors Organizations and individuals that are not affiliated with, directed by, or funded through the government. Duty Bearers Those actors who have a particular obligation or responsibility to respect, promote and fulfill human rights.
  • 7. DEFINITION OF TERMS Claim Holders All individuals are rights-holders that can make legitimate claims. Human Rights Violation It can be committed by people who work for the State and their behavior is then considered to be the behavior of the State. Why?
  • 9. First : “None of us asked to be born. And regardless of who our parents are and what they own, all of us are born equally naked and helpless, yet with his own hand, his own will and talents”. ? All of us have equal rights to life, and share the same inherent human dignity. Thus we all have the right to life, to dignity and develop ourselves. - These are traditionally known as the rights of men.
  • 10. Second: “Even if we may not know who our parents are, we are never born without parents, and never outside society, a society with its own peculiar culture, history and resources”.
  • 11. Third : “Once a society reaches a certain degree of complexity, as almost all societies have, society can act only through government. But a government always acts as agent of the society; it never becomes the society it self; it never becomes the people themselves.

  • 19. LOI PAMANA 55/07 HRAO – one office that is dedicated to helping fulfill the country’s international commitment and obligation to respect, protect and promote human rights. HuRAISE – Human Rights Recording, Analysis Information System and Enforcement.

  • 22. WHAT IS HUMAN RIGHTS-BASED POLICING?
  • 23. RIGHTS-BASED POLICING ? Compliance with Local and International human rights standards in policing. ? Police Officers are DUTY-BEARERS with obligations to respect, protect and fulfill human rights. Strengthening their capacities is also a must in order for us to empower the claim-holders. ? Citizens are CLAIM-HOLDERS whose rights must be respected and protected by the police. There is also a need for them to be empowered so that they will learn on how to claim their rights
  • 25. 1. Strict observance to Police Policies and Operational Procedures When police officers follow and apply proper procedures, they uphold human rights while doing all that is possible to ensure that the subsequent case to be filed in court against a suspect would prosper, in the higher interest of justice. 2. Adherence to National, Domestic and International Laws, Treaties, Standards, and Protocols on Human Rights ? PNP personnel must know, understand and adhere to local laws related to human rights, like, but not limited to RA7438, RA9745, RA9851 ? international human rights standard.

Professional Competence and Courteous Service A Police or Law Enforcement Professional must: ? have a high degree of practical knowledge about laws and ordinances, police policies and regulations, and police operational procedures; ? and must be courteous and considerate. 4. Respect for Rule of Law and Civilian Supremacy All police officers must always remember that “… sovereignty resides in the people and all government authority emanates from them.” 5. Pro-Democracy and Pro-Citizen The PNP must always remain responsive and relevant to the needs of the community.
  • 27. BASIC STATE OBLIGATIONS ? To RESPECT human rights - avoid interfering with the enjoyment of people’s rights. ? To FULFILL human rights - implement systems, mechanisms, and procedures that enable people to claim and enjoy their rights. ? To PROTECT human rights - equal protection to all persons and not to allow others from interfering with the exercise of the rights by another
  • 28. UNDERSTANDING THE ROLE OF THE COMMISSION ON HUMAN RIGHTS
  • 30. COMMISSION ON HUMAN RIGHTS The Commission on Human Rights (CHR) is an independent National Human Rights Institution (NHRI) created under the 1987 Philippine Constitution, established on 05 May 1987 by virtue of Executive Order No. 163.
  • 31. COMMISSION ON HUMAN RIGHTS An independent Constitutional Office The conscience of the Government An Investigating Body (recommendatory)
  • 32. COMMISSION ON HUMAN RIGHTS Functions: ?Investigate, on its own or on complaint by any party, all forms of human rights violations involving civil and political rights; ?Exercise visitorial powers over jails, prisons, or detention facilities;
  • 33. COMMISSION ON HUMAN RIGHTS ?Provide appropriate legal measures for the protection of human rights of all persons within the Philippines, as well as Filipinos residing abroad, and provide for preventive measures and legal aid services to the under-privileged whose human rights have been violated or need protection;
  • 34. COMMISSION ON HUMAN RIGHTS ?Monitor the Philippine Government's compliance with international treaty obligation on human rights; ?Request the Assistance of any department, bureau, office, or agency in the performance of its functions.
  • 35. WHAT ARE THE EFFECTS OF HRV CASES? ?Non-issuance of CHR Clearance; ?Barred from entering some countries; ?Barred from joining some trainings abroad sponsored by other countries or the Philippines; ?Barred from working abroad; and ?Disqualified from joining some National Awards/Recognitions
  • 37. A group of scientists placed 5 monkeys in a cage and in the middle, a ladder with bananas on the top.
  • 38. Every time a monkey went up the ladder, the scientists soaked the rest of the monkeys with cold water.
  • 39. After a while, every time a monkey went up the ladder, the others beat up the one on the ladder.
  • 40. After some time, no monkey dare to go up the ladder regardless of the temptation.
  • 41. Scientists then decided to substitute one of the monkeys. The 1st thing this monkey did was to go up the ladder. Immediately the other monkeys beat him up. After several beatings, the new member learned not to climb the ladder even though never knew why.
  • 42. A 2nd monkey was substituted and the same occurred. The 1st monkey participated on the beating for the 2nd monkey. A 3rd monkey was changed and the same was repeated (beaten). The 4th was substituted and the beating was repeated and finally the 5th monkey was replaced.
  • 43. What was left was a group of 5 monkeys that even though never received a cold shower, continued to beat up any monkey who attempted to climb the ladder.
  • 44. If it was possible to ask the monkeys why they would beat up all those who attempted to go up the ladder, I bet the answer would be… “I DON’T KNOW --- THAT’S HOW THINGS ARE DONE AROUND HERE.” Does it sound familiar?
