In 2008, Joe Tacopina of Tacopina Seigel & Turano, P.C., obtained an
acquittal on second-degree murder charges for client Lillo Brancato Jr., an
actor who had featured in roles in The Sopranos on television and A Bronx
Tale on the big screen. Brancato had participated in the burglary of a New
York residence in order to steal drugs. He was accompanied by Steven
Armento, who was later convicted of pulling the trigger in the shooting
death of off-duty policeman Daniel Enchautegui when he came to
investigate his neighbors home after seeing signs of the break-in.
The Bronx jury accepted Tacopinas argument that his client had not
known his accomplice was armed, was not carrying a weapon himself, and
did not engage in the actual killing. Tacopina acknowledged the tragedy of
Enchauteguis death while maintaining that his client should not have been
convicted for the murder committed by his companion.
In late 2013, Brancato was released on parole after serving eight years of
a 10-year burglary sentence in the Hudson Correctional Facility. Tacopina
had hoped to convince the trial judge to impose a minimum sentence with
mandated drug treatment but said he had known that such an outcome
was unlikely. At the time of his parole, Brancato, a prot辿g辿e of actors
Robert De Niro and the late James Gandolfini, expressed regret for his
past actions and acknowledged his obligation to meet all the conditions of
his release from the correctional facility.
