WILDLIFE ACT 1972
Wildlife
• Wildlife traditionally refers to non domesticated animal species, but has come to include all plants,
fungi and other organisms that grow or live wild in an area without being introduced by humans.
Wildlife protection act
• The wildlife protection act,1972 is an act of the parliament of India enacted for protection of plants and
animals species.
• It extends to whole India except Jammu and Kashmir.
• Before 1972,India only had five designated national parks.
Objectives
• Prohibition of hunting of specified wild animals, birds and plants.
• Setting up and management of national parks and wildlife sanctuaries.
• Control of trade and commerce in wildlife and wildlife products.
The act includes
• 7 chapters
• 66 sections
Chapter 1-Preliminary
Chapter 2-Authorities to be appointed /constituted wildlife act
Chapter 3-Hunting of wild animals
Chapter 4-Protected areas
Chapter 5-Trade /commerce in wild animals
Chapter 6-Prevention and detection of offences
Chapter 7-Miscellaneous reforms
Hunting of wild animals
• The act prohibits hunting of wild animals. No person shall hunt any wild animal as
specified in the schedules.
• However there are some exceptions to it.
• If the animal as become dangerous to human life or disabled beyond recovery.
• Killing or wounding in good faith in defence of oneself or any other person
• Any wild animal killed or wounded in defence of any person shall be government property
Trade or commerce in wild animals
• No person shall
• Commerce or carry on the business as
• Manufacturer, dealer of the scheduled animal or animal articles
or captive animals
• Dealer in meat derived from any scheduled animal in eating –
house
Penalities
• If any person who contravenes /any provision of this act shall be guilty of an offence against
this act, such person is under conviction ,punishable under imprisonment upto 3 years or
fine of 25000 or both
• Case of 2nd time or subsequent offence is punishable under imprisonment not less than 3
years but it may extend upto 7 years or fine 25000
• Any person who contravenes chapter of act like prohibition of trade and commerce of wild
animal ,imprisonment not less than 3 years but may extend upto 7years and a fine of 10,000
• If any person who intervenes section 38 teasing of zoo animals –
imprisonment upto 6 months, fine of 2000
• 2nd or subsequent offence –term of imprisonment may extend upto 1
year, fine of 5000
