Numerous corporations have renewed their efforts to support the rights of migrant workers. Many corporations make such pledges internally or with their customers, but it’s refreshing to see such a commitment as the H&M company has made with an inter-governmental agency, reflected New York based immigration attorney Jon Purizhansky.

Corporations Step-up to Protect Migrant Workers

Corporations and governments throughout the world are working together to protect migrant
workers. On December 9th, the Swedish clothing corporation, H&M Group, renewed its interest in this
area by pledging to promote the ethical recruitment and protection of migrant workers in global supply
chains. The pledge was memorialized through a memorandum of understanding (MOU) with the
United Nations agency International Organization for Migration (IOM).

The H&M Group has a particular interest in around
workers’ rights. They are a multinational clothing-
retail company that operates in 62 countries with
over 4,500 stores and employs over 132,000
people. It is one of the largest global clothing
retailers having an online presence in over thirty
countries.

H&M’s Head of Sustainability, Anna Gedda, executed
the MOU on behalf of the company. The company
stated that “unethical recruitment practices and gaps
in the governance of labor migration” are among the
leading risks impacting global migrant workers in
todays economy.

Migrant workers are routinely taken advantage of, there are unethical fees charged to workers, rampant
fraud during the recruitment and on-boarding process, and seizure of personal documents, says Jon
Purizhansky. These have been issues for many years, and while governments have tried to remedy these
practices they still exist today. Having major corporations getting involved in this area draws attention to a
global issue and which can ultimately bring change.

IOM is a major United Nations initiative drawing
attention to this issue. They are the leading
international organization for migration and routinely
work with the international community to address
challenges in migration management. IOM also
promotes and advances the understanding of migration
issues and supports economic and community
development through migration. One of their critical
value statements is to uphold the dignity and well-being
of migrants and their families.

1951 and is supported by 173 member states. Being an arm of the United Nations provides the
resources and awareness of migration matters on a wide-global scale and the tools to drive

The United Nations estimates that there are roughly over 370 million indigenous peoples living around the world, from the Arctic to the South Pacific, in over 90 countries. Indigenous peoples are responsible for a great deal of the world’s linguistic and cultural diversity, and their traditional knowledge is an invaluable resource; it is estimated that indigenous peoples occupy approximately 20 per cent of the world’s land surface, yet steward 80 per cent of the planet’s biodiversity. Combined with their unique cultural and spiritual ties to ancestral lands and territories, indigenous peoples are often fitting custodians of natural resources and ecological knowledge. This often symbiotic relationship with land can on one hand make indigenous peoples sought after as potential partners for business ventures in various industries, and on the other hand make them vulnerable to potential negative impacts of commercial development. Historically, many indigenous peoples have suffered from abuse, discrimination, and marginalization, and in many areas this continues today. As a result, many indigenous peoples live in poverty and poor health and their cultures, languages and ways of life are threatened. Indigenous peoples comprise 5 per cent of the world’s population, yet they make up 15 per cent of the world’s poor and one-third of the world’s extremely poor. In many areas, their average life expectancy is shorter than non-indigenous people. Facing these realities, indigenous peoples are often particularly vulnerable to the negative impacts of commercial development and business activities. There may be a sense of distrust by indigenous peoples towards the business community and State actors as a result of historical mistreatment such as dispossession and degradation of land and various human rights abuses. Harm has occurred when indigenous peoples unwittingly become parties to an agreement without informed understanding of its full implications. Further, indigenous peoples and their cultures often lack full legal protection at the State level. Unfortunately, some businesses have either directly or indirectly caused or contributed to adverse impacts on indigenous peoples’ rights, and in some cases such impact has been irremediable. Business faces both challenges and opportunities when engaging with indigenous peoples. When businesses collaborate with indigenous peoples, they are often able to achieve sustainable economic growth, for ex-ample, by optimizing ecosystem services and harnessing local or traditional knowledge. Positive engagement with indigenous peoples can also contribute to the success of resource development initiatives – from granting and maintaining social licenses to actively participating in business ventures as owners, contractors and employees. Failing to respect the rights of indigenous peoples can put businesses at significant legal, financial and reputational risk. For example, for a world-class mining

As more countries move from employer liability as the basis for employment injury protection to a mechanism based on social insurance, levels of protection for workers are likely to improve but only if new laws are effectively enforced. Disability benefits Social protection plays a key role in meeting the specific needs of persons with disabilities with regard to income security, access to health care and social inclusion. Effective measures to support persons with dis-abilities in finding and retaining quality employment are a key element of non-discriminatory and inclusive policies that help to realize their rights and aspirations as productive members of society. Complementing contributory schemes, non-contributory disability benefits play a key role in protecting those persons with disabilities who have not (yet) earned entitlements to contributory schemes. Only 87 countries offer such non-contributory benefits anchored in national legislation, which would provide at least a minimum level of income security for those disabled from birth or before working age, and those who for any reason have not had the opportunity to contribute to social insurance for long enough to be eligible for benefits. Maternity protection Effective maternity protection ensures income security for pregnant women and mothers of newborn children and their families, and also effective access to quality maternal health care. It also promotes equality in employment and occupation. Worldwide, less than 40 per cent of women in employment are covered by law under mandatory maternity cash benefit schemes; 57 per cent if voluntary coverage (mainly for women in self-employment) is included. Due to the ineffective enforcement and implementation of the law in some regions (Asia and the Pacific, Latin America and Africa in particular), effective coverage is even lower: only 28 per cent of women in employment worldwide are protected through maternity cash benefits which provide some income security in during the final stages of pregnancy and after childbirth; the absence of income security forces many women to return to work prematurely. An increasing number of countries are using non-contributory maternity cash benefits as a means to improve income security and access to maternal and child health care for pregnant women and new mothers, particularly for women living in poverty. However, significant gaps remain. Ensuring effective access to quality maternal health care is of particular importance, especially in countries where the informal economy accounts for a large pro-portion of employment. Old-age pensions: A state responsibility The right to income security in old age, as grounded in human rights instruments and international labour standards, includes the right to an adequate pension. However, nearly half (48 per cent) of all people over pensionable age do not receive a pension. For many of those who do receive a pension, pension levels are not adequate.

Many corporations make such pledges internally or with their customers, but it’s refreshing to see such a commitment as the H&M company has made with an intergovernmental agency, reflected New York based immigration attorney Jon Purizhansky. They are a multinational clothing- retail company that operates in 62 countries with over 4,500 stores and employs over 132,000 people. Migrant workers are routinely taken advantage of, there are unethical fees charged to workers, rampant fraud during the recruitment and on-boarding process, and seizure of personal documents, says Jon Purizhansky. These have been issues for many years, and while governments have tried to remedy these practices they still exist today.
