SUBJECT: AMENDMENT TO THE MANUAL OF APPROVALS ON
ADMINISTRATIVE, HUMAN RESOURCE, FINANCIAL
AND INTERNALAUDITING MATTERS
In the interest of service and in order to expedite the processing of
documents pertaining to administrative, human resource, financial and internal
auditing matters, a new Manual of Approval is hereby prescribed.
The attached manual shall form part of this Administrative Order and shall
serve as guide and reference on the delegated authorities to officials in the
Central Office, Bureaus, Regional Offices, PENROs, CENROs and Attached
Agencies.
This Order shall take effect immediately and all parts or provisionsof DAO
Nos. 2000-11 and 98-24 and DENR Memorandum Circulars on administrative,
human resource, and financialmatters are hereby amended, accordingly.

COVERAGEAND GENERAL PROVISIONS
I.ADMINISTRATIVE
APPOINTMENT
The PERSONNEL SELECTION BOARD (PSB) shall cover both the recruitment and
selection of employees in the IS'and 2ndlevels of the career service who are entering
the civil service for the first time or are being re-employedlreappointed, and the
screening of employees who are considered for promotion.
The 3RD LEVEL PERSONNEL SELECTION AND PROMOTION BOARD acts on the
selection and promotion of all applicationsfor salary grades 27 and above positions.
Personnelcategories are divided into:
1. First Level -. Salary Grades 1-10
2. Second Level - Salary Grades 11-24
3. Third Level - PresidentialAppointees and PENROs
DisciplinaryActions
The general rule in the law on Public Officers is that the power to appoint carries with it
the power to removean employee. The Civil Service laws, rules and regulationsgovern
administrative proceedings including impositionof penalties.
The Central Office Grievance Committeeis composed of the following:

Bilis Aksyon Partner (Chief of Welfare and Discipline Section,

Two representatives from the rank-and-file (one for is'level and
another for 2"dlevel who shall serve for a term of two years). In
offices where there are accredited or recognized employee
unions, the rank-and-file representativesshall be those named by
the employee union.

6. Reassignmentoutside aeoaraphical location if with consent shall have no limit.
However, if it is without consent, reassignment shall be for one (1) A-R..-
year only. Reassignment outside geographical location may be from
one regional office (RO) to another RO or from the RO to the Central Office (CO)
and vice-versa.
Reassignment is presumed to be regular and made in the interest of public
service unless proven otherwise or if it constitutes constructive dismissal.
Constructivedismissal exists when an official or employee quits his or her work
because of the agency head's unreasonable, humiliating, or demeaning
actuations, which render continued work impossible because of geographic
location, financial dislocation and performance of other duties and responsibilities
inconsistentwith those attached to the position. Hence,the employee is deemed
illegally dismissed. This may occur although there is no diminution or reduction
in rank, status or salary of the employee.

GENERAL PAYROLL
The General Payroll shall be used for the payment of salaries, wages, overtime
pay, honoraria and other emoluments of government officers and employees. This form
shall be prepared in triplicate copies to be distributedas follows:

PREVENTIVESUSPENSION
Preventive suspension of a civil service employee or officer pending an
investigation can be ordered even without a hearing because such suspension is not a
penalty but only a preliminarystep in an administrativeinvestigation.Further,if found not
guilty, proceduralguidelinesshall beformulated separately by the LegalService.
However, when a respondent's guilt is confirmed, preventive suspension is
punitive and is considered part of the penalty, pending hidher appeal. The purposeis to
prevent the accused from using his position or ofice to influence prospectivewitnesses
or tamper with the recordswhich may be vital inthe prosecution of the case against him.

The Appointing Authority in any Department, Bureau, Regional Offices, etc. may
preventively suspend any subordinate officer or employee pending an investigation, if
the charge against such officer or employee involves dishonesty, oppression or grave
misconduct, or neglect in the performance of duty, or if there are reasons to believethat
the respondent is guilty of charges which would warrant his removal from the service
(Section 51, ExecutiveOrder No. 292, 1987).
