6. SCHEDULE OF RECURRING SUPPLIES
The Bidder is required to deliver the following services related to the recurring expenses
as per the Schedule below, failing which the penalties shall be imposed to the Bidder:
Services Schedule
Consumables/Stationery The Bidder shall provide 400 CD-RW for students and
teachers, 20 Ream Paper, 4 Printer Cartridge per year per
school during the contract period within 30 days from the I &
C of the computer lab in the first year and till the month of
July in subsequent sessions.
Course materials/Books The Bidder shall provide the course materials/books in each
school within 60 days from the date of providing of the
approved syllabus by the Directorate of Education in the first
year and in the month of April in subsequent sessions.
Electricity Bills The Bidder shall pay Electricity Bills for all 1110 Schools
before the due date. Any penalties on the Electricity Bills
shall not be reimbursed by TCIL.
Generator Fuel The Bidder shall ensure to provide the Generator fuel timely
in all the schools for smooth running the ICT labs in case of
electricity failure.
Faculty Salary The Bidder to recruit and appoint faculty in each school
before commissioning of ICT Labs and shall pay the Monthly
salaries of the Instructors every month timely.
Telephone/ Internet Bills The Bidder shall pay Telephone/ Internet Bills for all 1110
Schools before the due date. Any penalties on the Telephone/
Internet Bills shall not be reimbursed by TCIL.

8. PENALTY AND TERMINATION DUE TO NON-FULFILLMENT OF TENDER
TERMS
a) Penalty for absence of facult y :
i) The Bidder shall ensure that the computer teacher attends the school
regularly and a substitute is provided in his/her absence. If the
teacher provided by the Bidder is absent from the school and no
substitute is provided, the Bidder shall be liable to pay a fine of Rs.400/-
per day per school for absence of the teacher. However one day leave will be
allowed for the faculty in a month which shall not be accumulated/ carry
forward.
ii) More than one change of computer teacher in a school within a year
will attract a penalty of Rs.5,000/- per change (i.e. 2nd change and any
change thereafter of one teacher will attract penalty). However, in the
case of transfer on account of forced condition such as accident, marriage
and resignation of computer teacher or on the request/direction of
concerned HoS, no such penalty shall be imposed.
iii) No computer teacher shall work in both shifts of a school or in two schools
under any circumstances. If any teacher is found to work in two
shifts/schools, he/she shall be treated absent for both the shifts/schools.
Further, no payment shall be made and penalty shall be imposed against the
Bidder after treating him/her absent in both the schools/shifts.
b) Penalty for delay/short supplies of consumables/stationery supplies of sub-
standard materials
The Bidder shall provide 400 CD-RW for students and teachers, 20 Ream Paper,

Printer Cartridge per year per school during the contract period within 30 days
from the commissioning of the computer lab in the first year and till the month of
July in subsequent sessions. A penalty of Rs.5,000/- per month per school shall
be levied on the Bidder for the delayed/short supplies/ supplies of sub-standard
materials of these items to the schools concerned. In case of delay/short supply,
the penalty will be counted from the expiry of 30 days after commissioning of lab
in the first year and thereafter from Ist August of every year.
c) Penalty for delay/short supplies of course materials/books/ supplies of sub-
standard materials
The Bidder shall provide the course materials/books in each school within 60 days
from the date of providing of the approved syllabus by the TCIL / Directorate
of Education in the first year and in the month of April in subsequent sessions.
A penalt y of Rs.5,000/- per month per school shall be levied on the Bidder for
the delayed/short supplies/supplies of sub-standard materials of these items to
the schools concerned. In case of delay/short supply, the penalt y will be counted
after expiry of 60 days from the date of providing of approved syllabus by TCIL /
DOE in
the first year and thereafter from 1
st
May of every
year.
d) Penalty for delay in replacement of items in case of not meeting specifications
If any goods or its component fails to meet the specifications, bidder shall
replace the goods or its component with required specification or higher within 7
days of such inspection, failing which a penalty of Rs. 500/- per day per equipment

e) Penalty for delay in implementation of the recommendation of TAC or any other
committee
The bidder shall ensure implementation of the recommendations of TAC or any
other committee constituted by the TCIL / Director of Education, within 45
days from the date of the order failing which a penalty of Rs.5,000/- per month per
school shall be levied on the bidder by the TCIL / Director of Education.
f) Penalties for delay in logging the complaint for failure of Hardware and Peripherals:
Bidder shall ensure same day logging of the complaint for failure of ever
y equipment in the lab including Hardware, peripherals & Lab infrastructure
items during the contract period so that the complaints are immediately attended
by the respective suppliers / OEMs. If the logging of complaint is not done
immediately then penalty of Rs. 500/- per day per school will be charged for
each individual equipment such as computer hardware & peripherals and Rs.
100/- per day per equipment will be charged for each individual Lab infrastructure
items.
The days for the penalty are to be calculated from the date of lodging the
complaint.
9. TERMINATION OF CONTRACT FOR DEFAULT
Without prejudice to any other remedy available for the TCIL/Dte. of Education for levying
penalt y or any other remedy, the purchase order / contract will be liable for termination
in part or whole if bidder fails to fulfill any of its obligations under the contract. TCIL
will give 10 days notice to bidder before terminating the contract.
10. ON SITE COORDINATION WITH REPSPECTIVE OEMS FOR
COMPREHENSIVE ONSITE WARRANTY & MAINTENANCE
The bidder is required to do the timely and effective coordination with supplier / OEMs for
Computer labs including Computer hardware & peripherals, Generator, Furniture, Operating
/ System Softwares, Educational Software and connected accessories, Lab
infrastructure items such as LAN switch, data cabling, wiring, Electrical points, Fans, CFLs
etc.

SCOPE OF WORK
6.1 Scope of Work
The Bidder is required to act as a single service provider for providing the services related
to recurring expenses in the Computers labs of 1110 schools (Govt. and Govt.- aided) in
Delhi for 5 years. The bidder will be required to provide 1 full time instructor in each
school, monthly remuneration of the instructors, Supply of stationary items, courseware
material, payment of Electricity charges, Generator fuel, Internet and Telephone charges,
Refresher training etc. in 1110 schools (Govt. and Govt.- aided) in Delhi for 5 years.
Scope of Work In detail:
The detailed scope of work / activities is as below:
1. The bidder has to undertake all the necessary activities required in this tender in all
1110 Govt. and Govt. Aided High Schools.
2. The Bidder shall provide one full-time instructor at each school with the minimum
qualification of basic graduation with PGDCA/BCA/MCA or other higher education
from reputed institutions.
3. The Bidder shall take complete responsibility for the monthly remuneration to be
paid to each faculty as per the guidelines of the scheme laid down by the MHRD
prevailing during the period of implementation for this scheme. The faculty shall
be available for the entire duration of school hours.
4. The Bidder shall ensure that the computer teacher is available during the normal
school hours of the school. However the services of the computer teacher can be
utilized as per the discretion of the TCIL/Director Education during
summer/autumn/winter breaks without any extra remuneration from the Directorate
of Education.
5. The faculty appointed by the Bidder shall provide computer education and
computer aided education from class VI to XII.
6. The faculty shall provide the assistance to the Head of School in using the
computers for school administration, EMIS, school management and monitoring
through e- mail.
7. The Directorate of Education has created 788 posts of PGT and 2026 posts of TGT
Computer Teacher in the schools under the Directorate. As and when the
recruitment of computer teachers is done by DSSSB, the faculty provided by
bidder shall be replaced by such permanent teachers. The payment made to the
bidder shall be reduced as per the quoted price for providing Faculty based on per
month per teacher basis for the replaced staff.

8. The tenure of computer teachers/faculties provided by the Bidder would be of 05
years or till joining of permanent computer teachers recruited by the Directorate. of
Education in the schools.
9. The Bidder shall comply with all the statutory provisions as laid down under
various Laws/Acts/Rules. In case of violation by the Bidder of any such statutory
provisions under any law applicable, TCIL/Directorate of Education will not bear
any cost of litigation or liabilities arising out of non-adherence of any Law by the
Bidder. The Bidder shall be solely responsible for this and undertakes to indemnify
& hold harmless the Government against all costs & consequences arising out
of such violations.
10. The Bidder shall not employ any person below the age of 18 years.
11. The Bidder shall provide 400 CD-RW per year per school to be used by the
students/teachers to keep record of their exceptional work, 4 Printer Cartridges per
year per school..
12. The Bidder shall provide 20 reams of computer stationery per year per school and
all kinds of consumables during the Agreement period without giving room
for stoppage or postponement of any scheduled learning activity.
13. The Bidder shall print and supply the courseware to each student for computer
education. A soft copy of the syllabus will be provided by TCIL / Director of
Education.
14. The Bidder shall provide Course material for computer education to each student in
Hindi/English as per CBSE syllabus. The responsibility towards DTP, print and
supply of course material shall completely rest with the Bidder and the costs
towards the same shall be included in the computer education delivery component.
15. The course material shall be supplied at the rate of one book for each of the student
for each of the academic year separately. The number of copies for course
material to be supplied shall be ascertained on the basis of actual enrolment in each
of the class/school.
16. The Bidder shall take special care to provide high quality content with abundant
pictures/graphics and shall also provide the printed course material books with high
quality cover page and paper.
17. The Bidder shall bear the electricity charges for running the Computer lab in the
school as per the sub-meter fixed. The payment of electricity charges shall be
made at the highest slab of electricity charges as applicable in the school.
18. The Bidder shall meet running expenses there on for a minimum period of 02 hours
per day.
19. The Bidder shall make provisions for broadband internet connection of at least 2
MBPS bandwidth in each school. Wherever that is not possible, connection of lower
bandwidth would be provided with plan to upgrade within 06 months. Wireless
links shall also be explored.
20. For covering internet as part of the syllabus, the Bidder must arrange/obtain a
broadband (preferable)/dialup connection at its cost. The internet connection
must

be available for the entire duration of the running of the school in each school for
the five year contract period and must be obtained for the exclusive use of the
students and teachers. The bidder must also maintain log book regarding the time of
usage by the students/teachers. This logbook must be available for inspection.
Internet connection must be provided within 30 days from the time of
commissioning of ICT labs in the school.
21. The Bidder shall provide refresher training on the topics working with
multimedia, overview of Management Information System, Computer technology
and security to
10(ten) teachers every year per school for 5 days (8 hours per day). The

22. The inspection and acceptance test may be done by TCIL / Department or through
third party identified by the department.
23. The bidder must produce the schedule of services within 15 working days of issue of
Purchase order.
24. The certificate of satisfactory services shall be issued by the concerned Principal
of the school and countersigned by the respective Dy. Directors and submitted to
the TCIL / Director. The TCIL / Director shall consider for payment to the bidder
after receipt of certificate of satisfactory service in the manner as prescribed above.
25. TCIL / Director, Education, shall form a committee for random checking of
computer labs for reviewing the project during every phase of the assignment. In
this regard the phase may be defined as the quarter for which payment is to be
made. The committee shall submit its reports to the Director for necessary action
within the stipulated period at the end of each quarter. The payment regarding
quarterly installments payment to the bidder will be made on the basis of the report
submitted by the committee.
26. TCIL / Director shall conduct a midterm review of the project after two years either
through a team constituted of the Officers from Dte. of Education or through a

27. Monitoring of the Computer Education Project shall be done by the TCIL / Director
of Education or by any person or team authorized by TCIL / Director of Education.
Mid-stream correction and issuing policy directives to remove bottlenecks and
difficulties encountered during the course of implementation of the project would
vest in the Technical Advisory Committee (TAC) constituted by the Director of
Education. Implementation of the contract in accordance with scheme will be
reviewed by the TCIL / Department periodically.
28. Recommendation made by the TAC or any other committee constituted by the
Director of Education, with regard to any modification in curriculum, consumables
and any other recommendations for fulfillment of the contract shall be binding
on the bidder.
OTHER TERMS & CONDITIONS
1. In the event of any breach of Terms & Conditions of this Tender on the part of the
Bidder, the Contract shall be terminated at any time by TCIL without any
compensation to the Bidder and the performance guarantee cum security deposit
shall also be forfeited.
2. The Bidder agrees for bearing the recurring expenses and to provide computer
education services to the students and teachers as detailed in the Tender. The rates
shall remain firm and is not subject to enhancement on any ground, during the
contract period.
3. The bidder shall provide Computer Education services strictly in accordance with
the technical specifications and terms and conditions as per Agreement.
They should comply with all the tests / recommendations specified by any
Technical Advisory Committee constituted by the TCIL / Director of Education,
Delhi or any other person authorized by TCIL / Director of Education
satisfactorily. The bidder shall ensure timely delivery as per the schedule of
services given in the tender.
4. The period of Contract shall be five years effective from the date of Purchase order /
start of deliverables of services as per tender which ever is later. However, it can
be extended for more period by mutual consent of both parties on agreeable terms.
5. The safe custody of the equipment, fixtures and fittings in the school in the
computer room shall be the responsibility of the Instructor during the working
hours. The
Instructor shall ensure that all the equipments are in order at the start of the day
and at the time of closing of the school which shall be duly entered in a log
book
maintained by the faculty and got verified by the Head of School. In case of theft
etc the Instructor inform the Head of School to file an FIR.
6. The bidder will not be permitted to operate from any premises other than the one
provided by the TCIL / Director of Education, Delhi to the bidder for the purpose.
7. The medium of instruction shall be Hindi and English.
8. The Bidder shall provide the address and contact number of Coordinators to all the
school heads so that the discrepancies arisen could be sorted out
swiftly.
9. The Bidder if it is based out side Delhi shall have to set up an office in Delhi within
a month from the signing of the
contract.
10. The Bidder shall not change the legal character of the company during the contract
period without the permission of the Director of

Education.
11. The schedule of services specified in the contract shall be strictly adhered to.
12. TCIL/ Director of Education, Delhi reserves the right to allot schools at his
discretion and the Bidder shall be bound by this decision.

13. The computer lab must be available for inspection by the competent authority at
any time.
14. The Department will be at liberty to use the computer labs set up in the schools for
official works and other enriched training for computer education. The
Department
may use the computer lab during vacations and holidays for training/teaching or
any other desirable purposes.
15. The Bidder shall not employ any person below the age of 18 years.
16. TCIL/ Department shall not be responsible financially or otherwise in case of any
injury to the staff deployed by the Bidder in the course of performing their duty
for and on behalf of the Bidder.
17. In case the Bidder stops/quits working in the mid without completing the prescribed
contract period under any circumstance, TCIL has the right to forfeit the
Performance Guarantee cum Security Deposit & other payments due to the Bidder.
The Bidder is also liable to be blacklisted for a period up to three years.
18. If at any stage the Bidder deviates from the terms and conditions of the
Agreement or its performance is found to be unsatisfactory, the
Contract/Agreement shall be
liable to be terminated and the Performance Guarantee cum Security Deposit shall
forfeited.
19. The Bidder shall indemnify TCIL against all damages/expenses for which the TCIL
may be held liable or pay on account of the negligence of the Bidder or its
servants
or any person under its control whether in respect of accident, injury to the person
or damages to the property or any member of the public or any person or in
executing the work or otherwise and against all damages and demands thereof.
20. The TCIL / Directorate of Education will be under no legal obligations to provide
any employment to any person of the bidder during or after expiry of contract
period and the TCIL / department recognizes no employer-employee relationship
between the TCIL / department and the personnel deployed by the bidder.
21. The Head of respective schools shall verify the requisite qualification of the
computer teachers at the time of joining in the school. No computer teacher without
requisite qualifications shall be allowed to join. Apart from this any person
authorized by TCIL/ Director of Education can ask the Bidder to satisfy itself about
the educational and other qualifications of the teacher deployed by the Bidder and
to remove unqualified computer teacher.
