Vid Hbt-socialdemokrater Sveriges andra ordinarie kongress som genomförts i
Eskilstuna den här helgen har följande uttalande antagits:
Försvara transpersoners mänskliga rättigheter!
Fortfarande saknar transpersoner i Sverige grundläggande mänskliga
rättigheter, som rätten att själv definiera sitt kön och sin identitet.
Transpersoner är inte heller lika inför lagen eftersom de är exkluderade från
diskrimineringslagens krav på aktiva åtgärder, grundlagens
diskrimineringsskydd samt och hets- och hatbrottslagstiftningen. Lagen om
fastställelse av könstillhörighet är normativ och kränker transpersoners
människovärde. Transpersoner ges i dag inte tillgång till den vård och
behandling som man har behov av.
Idag kan transpersoner inte ändra sitt juridiska kön utan att samtidigt
underkasta sig krav på medicinska eller kirurgiska ingrepp. Transpersoner bör
få rätt att fastställa önskat kön oberoende av fortplantningsförmåga,
medborgarskap, civilstånd och ålder.
Trots dessa upprörande särskillnader och diskriminering samt krav från bland
annat den samlade hbt-rörelsen har alliansregeringen med sin
kristdemokratiske socialminister fullständigt ignorerat dessa krav. Sverige har
inte råd med ytterligare fyra förlorade år.
Hbt-socialdemokrater Sverige kräver att
- en nationell och parlamentarisk utredning om transpersoners livssituation
tillsätts
- transpersoner inkluderas i hets- och hatbrottslagstiftningen
- transpersoner ges grundlagssskydd mot alla former av diskriminering
- transpersoner ges rätt till vård på lika villkor, oavsett var man bor i Sverige
och oavsett hur man väljer att definiera sin könsidentitet och sitt könsuttryck
- en ny lag om fastställelse av könstillhörighet skyndsamt tas fram
- transpersoner tillförsäkras rätten att fritt ändra sitt juridiska kön utan krav på
medicinska eller kirurgiska ingrepp
