While the company claims the additional dock is necessary, Hidgon does not agree. Hidgon also told Joel and Lottie Flemish they are violating the city ordinance limiting fence height to 6 feet after a neighbor complained their fence creates too much shade. The Flemish family appealed the Planning Commission's denial of their waiver request. Although Mayor Henry Smith's fence also violates the 6-foot limit, he claims it was built before the ordinance. Sidebar: Loading Dock/Fence Ordinance
Director of Public Works, Leonard Hidgon, rejects both requests for violating ordnances of an
intruding loading dock and 2 feet too high fence.
Hidgon has issued a Stop Work Order to the National Cold Storage Ice Company for a
loading dock they are constructing on Yale without a proper permit to do so. The dock violates
the law by proceeding 2.5 feet over the public right of way.
The Cold Storage Ice Company claims they find it necessary to build another dock to clear
the street of trucks being loaded with fruit from their plant, but Hidgon does not agree. I was
driving by one day when and stopped to see what was happening, Hidgon said. I saw they had
no permit so I red tagged it.
Although the Company realized they would possibly have to take it down, they were already
85 % done with construction. The Company asked for an Encroachment permit of 30 inches onto
City property that was alter passed.
Joel and Lottie Flemish, 125 3rd Avenue, were told they were violating the City Ordinance,
limiting the height of a fence to 6 feet, after a neighbors complaint that the fence created too
much shade in their backyard. The Flemish family sent in a request for a waiver that was turned
down by the Planning Commission. They have now appealed against that decision.
If we are going to have a fence ordinance that regulates fence heights and placements, then
we better enforce it uniformly, stated Mayor Henry Smith although his fence precedes the 6-feet
2. limit. Although his fence violates the fence limit to keep the city safe and beautiful, he claims it
was built before the ordinance law was made making it a lawful act.
According to Hidgon, it was okay for the National Cold Storage Ice Companys waiver to
reach approval because it meets code unlike the Flemishs fence.
