Open All Hours!
The Trading (Allowable Hours) Amendment Bill 2017
(Qld) (Bill) was passed by the Queensland Parliament
on Tuesday 22 August 2017. The Bill amends the
Trading (Allowable Hours) Act 1990 (Qld) (Act) by
reducing the restrictions on trading hours.
Key changes introduced by the Bill
The changes predominantly affect ‘non-exempt shops’,
such as supermarkets, department stores and fashion
stores.
There are now standardised trading hours for ‘non-exempt
shops’ – these stores will open from 8am to 9pm
(weekdays) across Queensland, except for:
â–ª in south-east Queensland, where shops open 7am to
9pm; and
▪ a ‘tourist area’, where shops open 6am to 10pm.
The hours differ for Saturdays and Sundays.
The restrictions are relaxed further for hardware stores, or
certain shops with:
â–ª no more than 30 (previously 20) persons engaged at
any one time in the shop; or
â–ª for owners of more than one independent retail shop,
no more than 100 (previously 60) persons engaged
at any one time in the shops.
The list of shops which are exempt from the standardised
hours in the Act has expanded to include butcher shops
and shops in particular tourist locations.
Businesses and other parties can also apply to become
exempt from the standardised hours during special events
(such as the upcoming Commonwealth Games).
Why is this important?
The Government is of the view that these reforms will
have wide-ranging economic and social benefits, such as:
â–ª increasing gross state product by up to an estimated
$79 million per year;
▪ enhancing the competitiveness of Queensland’s
retail and tourism industries; and
â–ª supporting up to an additional 945 full-time jobs (with
adequate protections for workers).
