         The item concerned is a plastic manifold, which measures approximately 6
inches high by 17 inches wide. It is made of a hard black nylon plastic and comes
with three anchoring screws attached, two clear plastic bags with additional plastic
fittings, as well as a removable fitted seal made of nylon plastic and rubber. You
state in your letter that the manifold is to be used in various 3.8-liter internal
combustion automotive engines either with, or without a supercharger.




       The applicable classification subheading for the Plastic Manifold will be
8409.91.5080, Harmonized Tariff Schedule of the United States (HTSUS), which
provides for Parts suitable for use solely or principally with the engines

   In your letter dated March 29, 2006, for Sudmo North America, you requested a tariff classification ruling. No sample was
submitted.         The In-Line CO2/O2 Measurement c-AGM and In-Line CO2 Measurement AGM measure the dissolved
levels of those gases in beverages passing through the piping that goes through them. The reading is displayed on its
screen.
   The Plato Monitor PLM measures the specific gravity of liquids. Plato monitors normally employ electrical-ultrasound
transducers in their method of measurement.           The applicable subheading for the c-AGM and AGM will be
9027.10.2000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "electrical" gas or smoke
analysis apparatus. The rate of duty will be 1.7 percent ad valorem.

    The applicable subheading for the PLM will be 9027.80.4560, Harmonized Tariff Schedule of the United States (HTSUS),
which provides for "other," "electrical" physical analysis instruments and apparatus. The rate of duty will be free.
    Regarding the Econ-Solutions, ECON, and the Carbo-Blender, CBR, we are returning your request for a ruling, and any
related samples, exhibits, etc.
    We need additional information in order to issue a ruling.
    Regarding the ECON, explain what each component in the imported "low-cost customized solutions" does and how it
does it. Also, what is the approximate percent of the total cost for each component?
    Regarding the CBR, is it production equipment? What is its approximate size and weight? Since the CO2 and O2

measurements are "optional," we will assume your imports have neither unless you explain to the contrary.

  In your letter dated March 29, 2006 you requested a tariff classification ruling on behalf of your client Sudmo North
America.

    You requested classification on four products: microfiltration, ultrafiltration, nanofiltration and reverse osmosis by X-Flow.
X-Flow manufactures membranes and modules for filtration, separation, concentration, and purification processes in the
water, beverage, dairy, and food industries as well as by the pharmaceutical and biotechnology industries. The microfiltration
is applied to water, beverages, food, biotechnological products and chemicals. Ultrafiltration (UF) relies on a system of semi
permeable membranes to separate a solution that has a mixture of some desirable components and some that are not
desirable. The driving force for transport across the membranes is a pressure differential. It is applied to water, beverages,
food, biotechnological products and chemicals. Nanofiltration is a form of filtration whereby membranes separate different
fluids or ions. Nanofiltration cannot reach the same purity as reverse osmosis, but it requires less energy to perform the
separation. It is applied primarily to water. Reverse Osmosis water filters and water filtration systems remove and reduce
contaminants of health concern.

   The applicable subheading for the microfiltration and ultrafiltration will be 8421.29.0065, Harmonized Tariff Schedule of

    In your letter dated March 29, 2006, for Sudmo North America, you requested a tariff classification ruling. No sample was
submitted.
    The Inpack 2000 C02 devices, the ICC, ICD and ICM all measure the dissolved carbon dioxide content of the beverage
via a calculation of the beverages temperature and the gas pressure after the bottle has been shaken and the top has been
pierced by the device. The ICC uses pressure transducers and displays the calculated carbon dioxide content on its screen.
The ICD and ICM require the user to calculate the carbon dioxide content with a special slide rule.
    New York Ruling Letter 863906 -104, 6-19-91, classified meters that measured the dissolved oxygen content of water
in HTS 9027.10. Similar oxygen meters are also cited in Harmonized System Explanatory Note 12 to HS 9027.
    Per the Haffmans internet site, the Inpack 2000 Air Meter, IAM, shows on a burette the milliliters of "foreign" gas present
in the volume above the beverage after the carbon dioxide has been removed by reaction with a caustic.
    Per the Haffmans internet site, the CO2 Purity Tester, CPT, shows on a measuring burette the percent, by volume, of the
"foreign" gas in the carbon dioxide via a measurement after the carbon dioxide has been remove by reaction with lye.
    The applicable subheading for the ICC will be 9027.10.2000, Harmonized Tariff Schedule of the United States (HTSUS),
which provides for "electrical" gas or smoke analysis apparatus. The rate of duty will be 1.7 percent ad valorem.

     Per the Haffmans internet site, in the Foam Stability Testers NIBEM-T and NIBEM-THP, the falling of the head of the beer
is measured via electrodes that have been projected down into it.

   In your letter dated March 29, 2006 on behalf of Sudmo North America you requested a tariff classification ruling.
   Your request lists four items: the INPACK 2000 Sampling Device (ISD), the Sample Bottle Filler (SBF), the Flasher Head
(FFH) and Manucol Ester B (MEB). The Manucol Ester B (MEB) is said to be a food-grade propylene glycol alginate used at
low levels.

   The applicable subheading for the Manucol Ester B (MEB) will be 3913.10.0000, Harmonized Tariff Schedule of the
United States (HTSUS), which provides for natural polymers (for example, alginic acid) and modified natural polymers (for
example, hardened proteins, chemical derivatives of natural rubber), not elsewhere specified or included, in primary forms:
Alginic acid, its salts and esters. The duty rate will be 4.2 percent ad valorem.

   Your inquiry does not provide enough information for us to give a classification ruling on the balance of the items in your

(FFH). Also submit operators manuals and technical specifications for each unit.
   Does the INPACK 2000 Sampling Device (ISD) operate on the lines of a pipette system? If not, how does it differ? Does it
perform any type of analysis? Device is said to be used in combination with a DO Meter. Include information on this meter.
How does the meter work and what is it measuring? Does the Sample Bottle Filler (SBF) merely fill bottles or does it also
perform an analysis of the sample? Does the Flasher Head (FFH) act like a pump by introducing and blending foam
concentrate into a flow of water to create foam? Does it incorporate a mixing head, nozzles or valves? Do these units contain
any refrigerating or freezing elements? How are they powered  e.g., electrically, hydraulically, pneumatically, etc.? Do they
have their own power source or do they derive their power from another machine?
   When this information is available, you may wish to consider resubmission of your request. We are returning any related

     In your letter dated March 29, 2006, for Sudmo North America, you requested a tariff classification ruling. No sample was

     The Redpost PU (Pasteurization Unit) Monitors RPU 353, 352 and 351 are used to measure how effectively
pasteurization equipment is performing its intended purpose.
Regarding the three channel version, the RPU 353, the Haffmans internet site states: "The most widely used method of
pasteurisation makes use of a tunnel pasteuriser, through which bottles or cans travel, while being sprayed with warm water.
The effect of heat treatment during a certain time is expressed in pasteurisation units (PU)..."     Further, "a bottle or can
filled with the product that needs to be pasteurised, is placed in the pasteurising monitor and is connected. The pasteurising
monitor is placed between the bottles or cans that travel through the tunnel pasteuriser.

During the pasteurisation process the pasteurising-monitor measures and stores the product temperature inside the bottle or
can in relation to the time and calculates the pasteurization units"      And "after passing through the tunnel, the number of
PUs is directly displayed on the pasteurizing monitor..."
   The descriptions for the RPU 352 and 351 are similar. The Pasteurization Units which they measure are indicative of the
expected kill rate of the bacteria within the product.   The Redpost RPC 80 and 50 are used only with Pasteurization
Monitors to serve primarily as their PC interface, printer interface, and charger after the PM has made its trip through the
pasteurization equipment. Their major functions are not covered, per se, by any one heading in HTS Chapters 84, 85, or 90.

RE: The tariff classification of Monitors, Meters, and Chemicals from the Netherlands
Dear Schreiber:

    In your letter dated March 29, 2006, for Sudmo North America, you requested a tariff classification ruling. No sample was
submitted.
    The Bottle Monitor BTM and the Keg Monitor KEG evaluate the performance of a bottle or keg washer by gathering at
various times temperature, conductivity, pressure, etc information as they pass through the washer. This is essentially to
check that the washer will meet the necessary standards of cleanliness when it cleans the production bottles or kegs prior to
their being filled.
The turbidity meters, article numbers VOS ROTA 90/25 and VOS ROTA 90 are used to measure turbidity of beer. According
to the information we obtained from the Sudmo website, turbidity of beer is an important quality parameter which affects the
shelf life of the product and its acceptance by the consumer. The VOS ROTA 90/25 and the VOS ROTA 90 laboratory
turbidity meters use the recommendations from MEBAK, a quality control organization for the beer industry.
In operation, the VOS ROTA 90/25 uses a red light source or a white light source operating at wavelength of 650 (plus or
minus 30) nanometers. Scattered light caused by haze particles in the beer is measured at 90 degree and 25 degree angles.
Smaller particles such as proteins mainly cause scattered light under 90 degrees. Larger particles such as yeasts mainly
cause forward scattered light. The VOS ROTA 90 operates in a similar manner to the VOS ROTA 90/25; however, the VOS
ROTA 90 measures the scattered light only under 90 degrees. The turbidity measurements are displayed on the meters LCD
screen.

   The applicable subheading for the BTM and KEG will be 9031.80.8085, Harmonized Tariff Schedule of the United States
(HTSUS), which provides for "other", non-"optical" measuring or checking instruments, appliances and machines, not
specified or included elsewhere in HTS Chapter 90. The rate of duty will be 1.7 percent ad valorem.

Dear Ms. Schreiber:

   In your letter dated March 29, 2006, for Sudmo North America, you requested a tariff classification ruling. No sample was
submitted.
   Per the Haffmans internet site, the Dew Point Tester DPT has a mirror on which condensation can be seen as soon as it
begins to form. At this point, the operator separately reads the temperature to determine the dew point of the gas that is
connected to it.        As indicated in Harmonized System Explanatory Note D-2 to HS 9025, a dew point measurement at a
given temperature is indicative of the moisture content of the gas.

   Per the Haffmans internet site, the Gauge Calibration Device GCD is a high precision dial pressure gauge which will be
connected to the same gas source as another pressure gauge or sensor. Since it is assumed to give an accurate pressure
measurement, the approximate accuracy of the other is indicated by looking at the differ ence between the results of both.
   The Schwartz Differential Agar SDA is a nutrient medium that detects the presence of aerobic bacteria (in the presence of
oxygen) and/or anaerobic bacteria (without the presence of oxygen) in beer or yeast slurries.

   The applicable subheading for the DPT will be 9025.80.3500, Harmonized Tariff Schedule of the United States (HTSUS),
which provides for non-"electrical," non-recording, hygrometers and psychrometers. The rate of duty will be 1.4 percent ad
valorem.

   The applicable subheading for the GCD will be 9026.20.8000, Harmonized Tariff Schedule of the United States (HTSUS),
which provides for non-"electrical" instruments and appliances for measuring or checking pressure. The rate of duty will be
free.

   The applicable subheading for the SDA will be 3821.00.0000, Harmonized Tariff Schedule of the United States (HTSUS),
which provides for prepared culture media for development of micro-organisms. The rate of duty will be 5 percent ad
valorem.

  Regarding the AEPA and the Total Lab Solutions TLS, We are returning your request for a ruling, and any related
samples, exhibits, etc.

   We need additional information in order to issue a ruling.
   Regarding the AEPA, 1) Please supply the chemical name, CAS registry number, and percent by weight of each

ingredient making up the calibration standard 2) Will the subject calibration standard be accompanied by a certificate of
analysis indicating the values of the certified properties, the methods used to determine these values, the degree of certainty
associated with each value, and the certifying authority?
   Regarding the TLS, provide a detailed description of each item in the imported "complete laboratory" including the
function of each. For each, what is its percent of the total cost?
