I.油PURPOSE油
To油protect油public油health油and油safety by油restricting油the油use油of water油from油private油wells油or油public油
water油systems油for油residential油outdoor油lawn油watering油during油a油state油or油federally油declared油drought.油
II.油AUTHORITY油
The油provisions油of油this油regulation are油adopted油pursuant油to油RSA油41:11足d,油Choice油and油Duties油of油
Town油Officers.油(See油Appendix油A,油Relevant油Sections油of油State油Law)油
III.油APPLICABILITY油
The油requirements油of油this油section油shall油apply immediately after the油public油notice油period油described油
in油Section油VII油to油all residential outdoor lawn watering油within油Insert油name油of油town,油city,油village油
district油when administrative油agencies油of油the油state油or油federal油government油have油designated油the油
region油as油being油under油a油declared油state油or油condition油of油drought.油
IV.油DEFINITIONS油
A.油 Drought:油A油sustained油and油regionally油extensive油occurrence油of油appreciably below油average油
natural油water油availability油in油the油form油of油precipitation,油stream油flow油or油groundwater.油The油
following油resources油are油used油by Insert油name油of油town,油city,油village油district to油determine油the油
declaration油of油a油drought油condition.油

The油following油limits油to油residential油lawn油watering油will油apply油under油drought油conditions.油油The油
specified油levels油(Level油1油through油3)油will油be油determined油by the油[local油governing油body]油and油will油be油
included油in油the油public油notice油required油under油Section油VII油of油this油regulation.油

The油State油of油New油Hampshire油 DEPARTMENT油OF油ENVIRONMENTAL油SERVICES油 ____________油 Thomas油S.油Burack,油Commissioner油 RESTRICTING油RESIDENTIAL油LAWN油WATERING油 DURING油STATE油OR油FEDERALLY油DECLARED油DROUGHTS油 August油2010油 Municipal油and油privately足owned油public油water油systems油have油had油the油authority油to油implement油water油 use油restrictions油for油water油system油customers油under油RSA 38:26.油Water油systems油with油potential油 water油supply油shortages油have油often油restricted油or油banned油residential油lawn油watering油to油ensure油an油 adequate油water油supply油is油maintained.油 In油2007,油the油legislature油adopted油RSA油41:11足d, authorizing油municipalities油to油restrict油all residential油 lawn油watering油for油areas油within油their油political油boundaries油if油the油state油or油federal油government油 declares油a油drought油condition油for油that油region油of油the油state.油This油authorizes油a油municipality油to油adopt油 regulations油to油restrict油residential油lawn油watering油during油a油drought油for油properties油that油obtain油water油 from either油public油water油systems油or on足lot油private domestic油wells.油 The油legislation油was油adopted油because油of油experiences油during油the油2001足2003油drought油when油 municipalities油and油the油state油found油there油was油no油clear油process油to油curtail油residential油lawn油watering,油 even油in油neighborhoods油where油private油residential油wells油were油dewatered.油During油the油drought,油 homeowners油with dewatered油or dry油wells油spent油thousands油of油dollars油to油replace油or油deepen油wells油 and油experienced油long油waits油due油to油the油increased油demand油for油water油well油contractor油services.油 Many homeowners油resorted油to油cross足connecting油their油home油plumbing油system油via油a油garden油hose油 to油a油neighbors油home油or油illegally油dumping油water油hauled油to油their油property油into油their油dewatered油 well.油 In油order油to油adopt油residential油lawn油watering油regulations油for油drought油conditions,油the油local油 governing油body may establish the油regulations油after油public油notice油that油includes油publishing油them in油 a油paper油of油general油circulation油in油the油municipality and油posting油them油in油at油least油two油public油places.油 The油regulations油may油be油implemented油and油enforced油three油calendar油days油following油notification.油 The油minimum油notification油requirements油are油provided油in油the油regulation油but油towns油are油encouraged油 to油find油supplemental油means油of油notification油to油residents.油RSA油41:11足d油allows油for油broad油flexibility油 in油developing油residential油lawn油watering油restrictions.油The油governing油body油of油the油municipality can油 specify油how,油where,油when,油and油to油what油extent油the油lawn watering油restrictions油apply.油The油 governing油body油may油also油enforce油the油lawn油watering油restrictions油by油imposing油fines油in油accordance油 with油RSA油625:9. B.油 If Insert油name油of油town,油city,油village油district油issues油a油Level油2油restriction,油then油 i.油 Residential lawn油watering油by油odd油numbered油addresses油is油allowed油on油Mondays油and油 Thursdays.油 ii.油 Residential lawn油watering油by even油numbered油addresses油is油allowed油on油Tuesdays油and油 Fridays.油 iii.油 Residential油lawn油watering油shall油not油occur油between油the油hours of 8AM油and油7PM油 C.油 If Insert油name油of油town,油city,油village油district油issues油a油Level油3油restriction,油then油 i.油 Residential lawn油watering油is油prohibited.油 VII.油PUBLIC油NOTIFICATION油OF油WATER油USE油RESTRICTION油 Notification油of油any油intention to油restrict油water油use油and油the油requirements油associated油with油Section油V油 shall油be油given油at油least油three油calendar油days油before油implementation.油Notice油of油the油regulations油shall油 be油posted油in油a油paper油of油general油circulation油and油shall油be油posted油in油at油least油two油public油places.油 Residents油are油specifically requested油to油takes油notice油of油the油marques油at油Insert油location(s)油 VIII.油TERMINATION油OF油WATER油USE油RESTRICTION油 Public油notification油and油termination油of油water油use油restriction油shall油be油given油in油accordance油with油 Section油VII.油 IX.油ENFORCEMENT油 Any油sworn油officer油of the油Insert油Town/City油Name油Police油Department油is油hereby油granted油the油 authority油to油initiate油any油enforcement油action油against油any油violation油of油the油provisions油of油this油 Regulation.油 X.油PENALTIES油 Any油person油failing油to油comply油with油the油restrictions油imposed油pursuant油to油this油Regulation shall油be油 deemed油a油violation油and油subject油to油penalties油pursuant油to油RSA油651:2.油 First油violation:油Warning油 Second油violation:油$Insert油amount油fine油 Additional油violations:油$油Insert油amount to油$1,000油fine

APPENDIX油A油 RELEVANT油SECTIONS油OF油STATE油LAW油 41:11足d油Restricting油the油Watering油of油Lawns.油油 I.油The油local油governing油body油may油establish油regulations油restricting油the油use油of油water油from油private油 wells油or油public油water油systems油for油residential油outdoor油lawn油watering油when油administrative油 agencies油of油the油state油or油federal油government油have油designated油the油region油as油being油under油a油declared油 state油or油condition油of油drought.油 II.油The油local油governing油body油shall油give油notice油prior油to油the油implementation油of油the油regulations油in油 paragraph油I.油Notice油shall油be油given油at油least油3油calendar油days油before油the油regulations油are油 implemented.油The油notice油required油under油this油section油shall油not油include油the油day油notice油is油posted.油 Notice油of油the油regulations油shall油be油published油in油a油paper油of油general油circulation油in油the油municipality油 and油shall油be油posted in油at油least油2油public油places.油 III.油The油full油text油of油the油proposed油regulations油need油not油be油included油in油the油notice油if油an油adequate油 statement油describing油the油proposal油and油designating油the油place油where油the油proposal油is油on油file油for油 public油inspection油is油stated油in油the油notice.油 625:9油Classification油of油Crimes.油油 V足a.油The油violation油of油any油requirement油created油by油statute油or油by油municipal油regulation油enacted油 pursuant油to油an油enabling油statute,油where油the油statute油neither油specifies油the油penalty油or油offense油 classification,油shall油be油deemed油a油violation,油and油the油penalties油to油be油imposed油by油the油court油shall油be油 those油provided油for油a油violation油under油RSA油651:2.油 651:2油Sentences油and油Limitations. 油 III足a.油A油person油convicted油of油a油violation油may油be油sentenced油to油conditional油or油unconditional油 discharge,油or油a油fine.油 IV.油A油fine油may油be油imposed油in油addition油to油any油sentence油of油imprisonment,油probation,油or油 conditional油discharge.油The油limitations油on油amounts油of油fines油authorized油in油subparagraphs油(a)油and油 (b)油shall油not油include油the油amount油of油any油civil油penalty,油the油imposition油of油which油is油authorized油by油 statute油or油by油a油properly油adopted油local油ordinance,油code,油or油regulation.油The油amount油of油any油fine油 imposed油on:油 (a)油Any油individual油may油not油exceed油$4,000油for油a油felony,油$2,000油for油a油class油A油 misdemeanor,油$1,200油for油a油class油B油misdemeanor,油and油$1,000油for油a油violation.油 (b)油A油corporation油or油unincorporated油association油may油not油exceed油$100,000油for油a油felony,油 $20,000油for油a油misdemeanor油and油$1,000油for油a油violation.油A油writ油of油execution油may油be油issued油 by油the油court油against油the油corporation油or unincorporated油association油to油compel油payment油of油 the油fine,油together油with油costs油and油interest.
