The country has endured periods of low national morale, such as in the 1970s when high inflation and the energy crisis worsened public sentiment following the Vietnam War. The current mood, however, feels different. Gallup recently reported that national mental health is at an all-time low, with few bright spots to lift spirits.
To better understand how Americans are feeling and their attitudes towards mental health in general, ThinkNow conducted a nationally representative quantitative survey of 1,500 respondents and found some interesting differences among ethnic, age and gender groups.
Technology
For example, 52% agree that technology and social media have a negative impact on mental health, but when broken out by race, 61% of Whites felt technology had a negative effect, and only 48% of Hispanics thought it did.
While technology has helped us keep in touch with friends and family in faraway places, it appears to have degraded our ability to connect in person. Staying connected online is a double-edged sword since the same news feed that brings us pictures of the grandkids and fluffy kittens also feeds us news about the wars in Israel and Ukraine, the dysfunction in Washington, the latest mass shooting and the climate crisis.
Hispanics may have a built-in defense against the isolation technology breeds, owing to their large, multigenerational households, strong social support systems, and tendency to use social media to stay connected with relatives abroad.
Age and Gender
When asked how individuals rate their mental health, men rate it higher than women by 11 percentage points, and Baby Boomers rank it highest at 83%, saying it’s good or excellent vs. 57% of Gen Z saying the same.
Gen Z spends the most amount of time on social media, so the notion that social media negatively affects mental health appears to be correlated. Unfortunately, Gen Z is also the generation that’s least comfortable discussing mental health concerns with healthcare professionals. Only 40% of them state they’re comfortable discussing their issues with a professional compared to 60% of Millennials and 65% of Boomers.
Race Affects Attitudes
As seen in previous research conducted by ThinkNow, Asian Americans lag other groups when it comes to awareness of mental health issues. Twenty-four percent of Asian Americans believe that having a mental health issue is a sign of weakness compared to the 16% average for all groups. Asians are also considerably less likely to be aware of mental health services in their communities (42% vs. 55%) and most likely to seek out information on social media (51% vs. 35%).

Argumentace výběru tématu
Toto téma jsem si vybrala, protože se v této době objevily v souvislosti s přímou volbou
prezidenta připomínky k naší Ústavě. To, že mě výstup naše „věrného“ spoluobčana Tomia Okamury
velmi rozčílil, nebudu komentovat. Byl to také důvod, proč jsem se rozhodla osvětlit si, co to vůbec
ústava je a co naše ústava obsahuje. Jelikož studuji obor Občanský výchova, je to zároveň jeden
s klíčových pojmů v naší výuce. Nejprve jsem si objasnila, co to vůbec ústava je a pak jsem se zaměřila
na ústavu v našem státě – z čehož je i definován název mého článku.
Anotace
Článek vysvětluje pojem ústava v mezinárodním měřítku. Dále se blíže specifikuje na Ústavu
České republiky, na její charakteristiku, původ, rozdělení a obsah. Ústava ČR obsahuje preambuli, 8
hlav a 113 článků. Spolu s Listinou základních práv a svobod (rozdělena do 6 hlav a 44 článků) tvoří
ústavní právo České republiky.

Co je to ústava?
Ústava nejen v České republice je jednoduše řečeno nejdůležitějším a nejvyšším zákonem
státu, od kterého se odvíjí všechny ostatní zákony státu. Všechny nižší zákony a právní předpisy státu
tedy musí být s ústavou v souladu. Ústavu nelze zrušit, nelze ji ani významně změnit tak, aby
odporovala zásadám daného typu státu. Může však být měněna nebo doplňována ústavními zákony.
Ústava ČR
Ústava České republiky byla přijata 16. prosince 1992 a platnosti nabyla 1. 1. 1993. Součástí
ústavního systému neboli pořádku je i Listina základních práv a svobod. Tyto dvě části dohromady
tvoří tzv. ústavní právo České republiky.
Charakter právního řádu a zároveň Ústavního systému ČR přiřazuje její právní kulturu ke
kontinentálnímu typu práva, který se vyznačuje důrazem na psané právo (zejména zákony a další
právní předpisy, jež jsou výsledkem záměrné legislativní činnosti zákonodárce). *1)

Původ Ústavy ČR
Základy moderní české právní kultury mají své počátky v období rakouské monarchie, kde
byly přijímány právní normy mimořádného významu (především Všeobecný občanský zákoník z roku
1811). *2)
Na rakouské základy našeho ústavního práva poté v roce 1918 navázalo právo ČSR, hlavně
tzv. recepční zákon z roku 1918, které upravilo zavedené rakouské normy. Za vůbec první
československou ústavu je považována ústava z roku 1920, která byla inspirována prvky ústavy
americké a francouzské, i přesto si však zachovala velkou částí ráz ústavy rakouské.

O Ústavě
Ústava České republiky obsahuje preambuli neboli úvodní prohlášení a 113 článků
rozdělených do osmi částí nazývaných hlavy. *3)

V této úvodní části se pojednává o věrnosti českého občana k tradicím, ochrana vytvořeného
bohatství a budování ČR jako rovnoprávného státu.

I. Základní ustanovení
Česká republika je naší Ústavou charakterizována jako svrchovaný, jednotný a demokratický
právní stát, kde je státní moc vykonávána pomocí orgánů moci zákonodárné, výkonné a soudní.
Rozhodnutí sice plynou z vůle většiny, práva menšiny však musí být zachována.
II. Moc zákonodárná
Tuto moc vykonává Parlament, který je tvořen dvěma komorami – Poslaneckou sněmovnou a
Senátem. Všichni zástupci do obou komor jsou voleni lidem. Poslanecká sněmovna má 200 členů
volených na 4 roky, Senát má 81 senátorů volených na 6 let, přičemž každé 2 roky se obměňují 2/3
členů.
V této hlavě je také popsáno volební právo, které je buď aktivní (jít volit – v ČR ho má každý
občan ČR, který dosáhl věku 18 let) anebo může být volební právo pasivní (tudíž právo být volen,
které je do Poslanecké sněmovny od 21 let a do Senátu a pro funkci prezidenta od 40 let). Dále jsou
zde popsány pravomoce, kompetence, funkce a ochrana členů Parlamentu a jejich usnášení se
schopnost, která je pro funkci státu nejvíce důležitá. Hlavní funkcí těchto orgánů je moc zákonodárná,
mají tedy na starost vytváření a přijímání zákonů.
III. Moc výkonná
Moc výkonná spadá do kompetencí prezidenta České republiky a Vlády.
Prezident ČR byl až do roku 2013 volen na 5 Parlamentem ČR. V roce 2013 však má v České
republice poprvé proběhnout přímá volba prezidenta občany. Termíny voleb jsou stanoveny na 11. a
12. ledna, druhé kole pak na 25. a 26. ledna.
Dalším orgánem výkonné moci je vláda, která má na starosti státní správu a státní moc.
Skládá se u předsedy, místopředsedy a ministrů. Ze své funkce je odpovědna Poslanecké sněmovně,
která pokud je s její prací nespokojena jí může vyslovit nedůvěru a ukončit tak její funkci. K usnesení
vlády je třeba nadpoloviční většiny jejích členů.
Ve vládě řídí ministři jednotlivá odvětví hospodaření, tato odvětví nazýváme rezorty.
IV. Moc soudní
Má na starost ochranu práv občanů. Soudcem může být bezúhonný občan, který má
dokončené vysokoškolské právnické vzdělání.
Soustavu soudů tvoří Nejvyšší soud, Nejvyšší správní soud, vrchní, krajské a okresní soudy.
Zvláštní postavení má Ústavní soud.

V. Nejvyšší kontrolní úřad
Kontroluje hospodaření se státním majetkem a plnění státního rozpočtu.
VI. Česká národní banka
Ústřední banka, která pečuje o stabilitu měny.
VII. Územní samospráva
ČR se člení na základní samosprávné celky, neboli obce a na vyšší samosprávné celky neboli
kraje. Česká republika je rozdělena na 14 vyšších samosprávných celků, přesněji 13 krajů a hlavní
město Prahu. Všechny tyto samosprávné celky mají vlastní majetek a rozpočet. V jejich čele jsou
zastupitelstva volená z řad občanů na dobu 4 let.
VIII. Přechodná a závěrečná ustanovení
Zahrnuje všechna souhrnná a závěrečná ustanovení.
Listina základních práv a svobod ČR
Tato listina má celkem 6 hlav a 44 článků.
Hlava první popisuje základní principy lidství a přístupu státu ke člověku. Od těchto principů a
ustanovení jsou pak rozvíjeny další závazky státu k ochraně člověka a naopak člověka k dodržování
zásad prospěšných pro chod státu a společnosti. Hned 1. článek je velmi důležitý hlavně z morálního
hlediska a říká:
„Lidé jsou svobodní a rovní v důstojnosti i v právech. Základní práva a svobody jsou
nezadatelné, nezcizitelné, nepromlčitelné a nezrušitelné.“
Tato listina je pro všechny občany velmi důležitá, všechny její prvky spadají pod ochranu
soudní moci. Tato smlouva je vázána a schválena Parlamentem České republiky a je vytvořena podle
smluv a pravidel mezinárodních organizací ochraňujících lidská práva. Všechny články jsou tedy
nadřazeny běžným zákonům a mají před nimi přednost.
