4월 20일부터, 국제노동기구 ILO(International Labour Organization)의 강제노동 금지에 관한 협약(제29호), 근로자와 사용자의 자유로운 단체 설립을 인정하는 결사의 자유와 단결권 보호 협약(제87호), 근로자와 사용자의 자발적 교섭을 보호하는 단결권 및 단체교섭권의 보장 협약(제98호) 등 3개의 핵심협약이 국내 정식 발효됨에 따라 국내법과 같은 효력을 갖게 됩니다. 노동계는 협약의 이행을 위해 특수고용직의 노동 3권 보장 등 추가 노동법 개정을 요구하고 있으며, 경영계는 노조의 권한이 지나치게 강화되는 것을 우려하여 노사관계의 불균형 해소를 위한 보완 입법을 요구하고 있습니다. 특히 제87호의 경우 파업할 권리를 포함하고 있는데요, 파업의 목적이 단체협약 사안에 제한되어서는 안 된다고 명시하고 있습니다. 따라서 현재까지 대법원 판례상 근로조건의 향상을 목적으로 한 파업만 합법으로 인정하고 구조조정이나 정부 정책에 반대하는 파업은 불법으로 보았으나, 앞으로는 판례의 변화가 예상됩니다.
